1.Shipping Policy

This Shipping Policy applies to all orders placed through www.best-poppers.eu, operated by Dutch Trading Company B.V. (“DTC“, “Best-Poppers“, “we”, “us”), Beitel 110, 6422 PB Heerlen, the Netherlands, KvK 82516480. It operates alongside our General Terms and Conditions (“GTC”) and our Privacy Policy. In the event of any conflict between this Shipping Policy and the GTC, the GTC prevails.
1. Shipping carriers and options
We dispatch your orders through reputable carriers in order to balance speed, tracking quality and price across destinations. The carrier that will handle your particular shipment is selected at the time of dispatch and indicated on your tracking link.
The carriers we currently use are:
Sendcloud — our multi-carrier shipping platform, which routes parcels via its affiliated carriers (including PostNL, DPD and others) according to destination and service level.
UPS — used independently of Sendcloud, for selected destinations and express services.
PostNL — standard tracked shipping, principally for orders within the Netherlands and the Benelux region.
DPD — tracked parcel shipping across the European Union.
All shipments are tracked. Once your parcel leaves our warehouse, you will receive a tracking link by e-mail; you can follow your shipment in real time using the carrier’s own tracking service.
2. Order processing
Orders are processed and shipped within 48 hours on working days (Monday–Friday, excluding Dutch public holidays), subject to stock availability and successful payment.
Products are shipped in solid, neutral packaging with a discreet return address — there is no external indication of the contents or of the brand on the outer packaging.
3. Shipping costs
Shipping costs are not included in the list price and are added to your order at checkout. The amount depends on the destination country, the weight and dimensions of the parcel, and the carrier or service level you select.
All prices shown at checkout are inclusive of value added tax (VAT / BTW) at the applicable Dutch or destination-country rate.
4. Estimated delivery times — not binding
Estimated delivery times shown at checkout, on product pages, in your order confirmation or in carrier tracking pages are indicative ranges based on the carrier’s published transit times. They are provided for information only.
Estimated delivery times are not binding on Best-Poppers and do not constitute a guaranteed delivery date within the meaning of articles 6:74 or 6:265 of the Dutch Civil Code (Burgerlijk Wetboek, “BW”). Actual delivery times may vary depending on the carrier’s operational situation, the destination, customs clearance (for non-EU destinations), public holidays and unforeseen circumstances.
Without prejudice to your statutory rights as a consumer, we will deliver your goods without undue delay and in any event within 30 days of the conclusion of the contract, unless we have agreed a different delivery date with you (article 7:19a BW). If we cannot meet that period, you may grant us a reasonable additional period or, where appropriate, cancel the contract — see §8 below and §5 of our General Terms and Conditions.
We are not responsible for delays caused by the carrier or by force-majeure events such as strikes, severe weather, customs hold-ups, public-health restrictions or any other circumstance beyond our reasonable control. If your shipment has not arrived within a reasonable period after the carrier’s estimated window, please contact us at info@best-poppers.eu and we will investigate the shipment with the carrier on your behalf.
5. Transfer of risk
If you are a consumer, the risk of accidental loss or accidental deterioration of the goods during dispatch passes to you only when the goods are handed over to you or to a third party — other than the carrier — designated by you (article 7:11 BW), irrespective of whether the dispatch is insured or uninsured.
If you are not a consumer (commercial buyer), the risk passes to you at the time of dispatch, i.e. when the goods are handed over to the carrier.
6. International shipments
For orders shipped outside the European Union, additional import VAT, customs duties and handling fees may be charged by the destination country. These charges are the responsibility of the recipient and are payable directly to the carrier or to local customs authorities at the time of delivery. We have no control over these amounts and cannot reimburse them.
It is the buyer’s responsibility to ensure that the goods ordered may lawfully be imported into the destination country. We accept no liability for parcels that are seized, returned or destroyed by local customs because the goods are prohibited or restricted in the destination country.
7. Lost, damaged or undeliverable shipments
Damaged on arrival — please document the damage with photographs of the outer packaging and the contents and contact us at info@best-poppers.eu as soon as possible after receipt. Where practicable, also report the damage to the delivering carrier at the door. This does not affect your statutory rights under articles 7:17 and 7:23 BW.
Lost in transit — if your tracking has not shown any movement for more than 7 working days (EU) or 14 working days (international destinations), please contact us and we will open an investigation with the carrier. A parcel is not considered definitively lost until the carrier has formally declared it as such; this can take up to the carrier’s published claim period.
Wrong or incomplete address — if a parcel is returned to us because the address supplied at checkout was incorrect or incomplete, we will contact you for a corrected address. The cost of reshipment will be charged to you at the same rate as the original shipping. This does not affect your right of cancellation under §8.
8. Cancellation and return
This section is a summary; the binding rules on the right of cancellation are set out in §8 of our General Terms and Conditions.
As a consumer, you may cancel your contract within 14 days from the day you (or a third party other than the carrier indicated by you) receive the goods (article 6:230o BW). To cancel, send an unequivocal statement to info@best-poppers.eu with the subject “Cancellation: Your order number”. You may use the model withdrawal form attached to our General Terms and Conditions.
You must return the goods within 14 days of your cancellation notice.
The direct cost of returning the goods is borne by you, unless we have expressly agreed otherwise.
Refunds — including the standard delivery costs you paid on the original order — will be processed within 14 days using the same payment method, subject to receipt of the returned goods or proof of return (article 6:230r BW). We may deduct the diminished value of any goods handled beyond what was necessary to establish their nature, characteristics and functioning (article 6:230s(3) BW).
Our warehouse does not accept COD (cash-on-delivery) return shipments.
9. Exclusions from the right of cancellation
In line with article 6:230p BW and §8.2 of our General Terms and Conditions, the right of cancellation does not apply to, in particular:
sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery (e.g. sex toys, lubricants, condoms, underwear);
goods that have been inseparably mixed with other items after delivery;
sealed audio or video recordings or sealed computer software which have been unsealed after delivery;
goods made to the consumer’s specifications or clearly personalised;
goods that are liable to deteriorate or expire rapidly.
10. Chargeback fee
In the event of an unjustified chargeback initiated by a customer in respect of a payment to Best-Poppers, a chargeback fee of €15.00 will be charged, corresponding to the actual administrative and processing costs charged to us by our payment service provider (article 6:96 BW). This fee does not apply where the chargeback proves to be justified. See §4.1 of our General Terms and Conditions.
11. Severability
If any provision of this Shipping Policy is held to be invalid or unenforceable, the remaining provisions remain in full force and effect. Any invalid or unenforceable provision shall be deemed replaced by the statutory provision that comes closest to the economic purpose of the original (conversie, article 3:42 BW).
12. Legal compliance and governing law
This Shipping Policy and all shipping arrangements between Best-Poppers (Dutch Trading Company B.V.) and the buyer are governed by the laws of the Netherlands, without prejudice to the mandatory consumer-protection rights you enjoy in your country of habitual residence within the European Union (article 6 of Regulation (EC) No 593/2008 — Rome I).
The buyer is responsible for ensuring that the imported goods comply with the laws and regulations of the destination country.
